Terms of Service

1. Acceptance of Terms

By creating an account or using the Unspiral mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Unspiral is operated by Leaplane, Lda, a company registered in Portugal.

2. Unspiral Is NOT a Therapy Service

Specifically:

• Unspiral is not a substitute for professional mental health treatment, counseling, or therapy.
• The AI coach's observations, classifications, and suggestions are for self-reflection purposes only and should never be interpreted as clinical diagnoses or professional recommendations.
• If you are experiencing a mental health crisis, severe emotional distress, suicidal thoughts, or any condition requiring professional care, you must seek help from a qualified mental health professional or emergency service immediately.
• You should not delay seeking professional help, disregard professional advice, or discontinue any treatment because of something you read or experience in the App.

By using Unspiral, you acknowledge and accept that the App is a self-awareness tool, not a healthcare service.

4. AI Limitations

Unspiral uses artificial intelligence (powered by Anthropic Claude) to generate responses. You should be aware of the following limitations:

• AI can make mistakes. Responses are generated by a language model and may occasionally be inaccurate, incomplete, or not applicable to your specific situation.
• Signal classifications are reflective, not diagnostic. When the AI coach classifies what you are experiencing (e.g., as anxiety, avoidance, or intuition), this is meant to prompt self-reflection, not to serve as a clinical or psychological diagnosis.
• Do not rely solely on AI assessments. The AI coach's observations are one perspective among many. They should complement, not replace, your own judgment and the guidance of qualified professionals.
• Context is limited. While the AI coach maintains conversation memory, it does not have full knowledge of your life circumstances, medical history, or mental health background.

5. User Content

5.1 Ownership

You retain full ownership of all content you create through the App, including your conversation messages and the resulting journal entries.

5.2 License

By using the App, you grant Leaplane, Lda a limited, non-exclusive license to process your content solely for the purpose of providing and improving the Unspiral service. We will not share, publish, or sell your content to third parties, except as described in our Privacy Policy.

5.3 AI-Generated Content

Journal entries, signal classifications, and suggested actions are generated by the AI based on your conversations. While these are derived from your input, the AI-generated analysis and text are provided as part of the service.

6. Acceptable Use

You agree to use Unspiral in good faith and in accordance with these Terms. You must not:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Submit content that is illegal, abusive, threatening, defamatory, or otherwise objectionable.
• Attempt to manipulate, exploit, or misuse the AI coach for harmful, deceptive, or malicious purposes.
• Attempt to extract, reverse-engineer, or replicate the AI coaching system, prompts, or underlying logic.
• Interfere with or disrupt the App's infrastructure, security, or functionality.
• Create multiple accounts to circumvent restrictions or abuse the service.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate your account if you violate these Terms.

7. Account Termination

7.1 By You

You may delete your account at any time through the in-app settings. Upon deletion, all your data (conversations, journal entries, user memories, and account information) will be permanently removed from our systems, as described in our Privacy Policy.

7.2 By Us

We may suspend or terminate your account at our discretion if we reasonably believe you have violated these Terms, or if continued provision of the service to you is no longer feasible. We will make reasonable efforts to notify you before or at the time of termination.

7.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including but not limited to Limitation of Liability, Governing Law, and the disclaimer that Unspiral is not a therapy service) will continue to apply.

8. Limitation of Liability

The App is provided “as is” and “as available,” without warranty of any kind, express or implied.

To the maximum extent permitted by applicable law:

• Leaplane, Lda makes no warranties regarding the accuracy, reliability, completeness, or suitability of the AI coaching service, signal classifications, journal entries, or any other content generated by the App.
• Leaplane, Lda is not liable for any decisions, actions, or outcomes resulting from your use of the App or reliance on AI-generated coaching, assessments, or suggestions.
• Leaplane, Lda is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
• Leaplane, Lda's total aggregate liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you have paid to Leaplane, Lda in the twelve (12) months preceding the claim, or fifty euros (€50), whichever is greater.

This limitation of liability applies to the fullest extent permitted by law and does not exclude liability that cannot be excluded under applicable law (including liability for fraud or willful misconduct).

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Portugal and applicable European Union regulations, including the GDPR.

Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Porto, Portugal, unless otherwise required by mandatory consumer protection laws in your jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App. Your continued use of Unspiral after such notification constitutes acceptance of the updated Terms.

If you do not agree with the revised Terms, you should stop using the App and delete your account.
